AI Frequency Radio Terms of Service

Effective date: September 30, 2026

These Terms of Service govern access to AI Frequency Radio, also known as AIFR and AIFR FM, including aifrequency.org, its associated radio streams, on-demand music, accounts, advertising services, and submission features (collectively, the "Service").

The Service is personally operated by an individual using the name LexianDEV, based in Ohio, United States. In these Terms, "AIFR," "we," "us," and "our" refer to that operator. Our operator website is lexian.dev, and our contact email is dev@lexian.dev.

Please read these Terms before using the Service. Where we ask you to accept these Terms, including when submitting music or purchasing an advertising plan, your acceptance forms an agreement with us. If you do not agree, do not use the features requiring acceptance. Nothing in these Terms limits rights that applicable law does not allow to be limited.

1. About the station

AIFR is an independently operated, self-funded internet radio station featuring AI-generated and AI-assisted music, creator submissions, automated programming, and live programming. We also provide on-demand listening, song requests, dedications, station news, and advertising features where available.

AIFR is not a registered nonprofit organization or a tax-exempt charity. Voluntary support payments and advertising revenue help fund the station's operation and development. Supporting AIFR does not give you ownership, voting rights, a financial return, or control over programming.

References to continuous or 24/7 broadcasting describe our intended schedule. They do not guarantee uninterrupted service.

2. Eligibility and accounts

General listening is available to listeners of all ages. Content may include explicit language or mature themes, and parents or guardians should supervise younger listeners as appropriate.

You must be at least 18 years old and legally able to enter into an agreement to create an advertising account, purchase a plan, make a support payment, or submit music. If acting for a business, artist, or other person, you must have authority to act for them.

Provide accurate account and contact information, keep it current, protect your password, and notify us promptly if you suspect unauthorized access. Do not share or use an account in a way that misrepresents who is responsible for it. You are responsible for activity you authorize through your account; applicable law governs responsibility for unauthorized activity.

Email verification may be required before paid advertising access can be activated. Creating an account does not guarantee approval of any advertisement or submission.

3. Listening, requests, and dedications

We permit you to access the Service and listen through our website or compatible media players for personal, noncommercial use, and to use the radio broadcast in creator content as permitted below, subject to these Terms and any applicable rights in the content.

Access to a stream or on-demand track does not generally grant permission to download, resell, separately redistribute, commercially license, or independently offer the music as your own service.

However, AIFR is intended to be streamer-friendly. You may play or restream AIFR's radio broadcast as background or accompanying audio within your own live or recorded content on platforms such as Twitch, YouTube, or similar streaming and video services, provided that you do not falsely claim ownership of the music or represent yourself as AIFR.

This permission applies only to uses that AIFR and the relevant music submitters have authority to permit. Platform rules, copyright law, and rights belonging to third parties may impose additional restrictions. AIFR cannot guarantee that a platform will not mute, block, demonetize, flag, or otherwise take action against content containing music broadcast by the station.

Song requests are subject to library availability, queue rules, technical limits, and programming decisions. A successful request does not guarantee a particular broadcast time or that the track will play.

Names, handles, shout-outs, and dedications you submit for broadcast may be read on air. Submit only information you are comfortable making public. Dedications must be family-friendly. We may decline, shorten, edit, or omit requests and dedications for suitability, privacy, clarity, or technical reasons.

4. Music submissions and your rights

Submitting music is voluntary. You retain whatever ownership and rights you hold in your submitted recordings, compositions, lyrics, artwork, and related materials. Submission does not transfer ownership to AIFR.

You represent that you own or control all permissions necessary for AIFR's authorized uses, including rights in the sound recording, musical composition, lyrics, samples, artwork, performances, names, and any third-party material. Obtain permission from collaborators and other rightsholders where required.

For AI-generated or AI-assisted material, you are also responsible for ensuring that the relevant AI service's terms permit the submission and the uses authorized here, including use on an advertising-supported station. Do not submit unauthorized voice or likeness imitations, misleading impersonations, or material that infringes another person's rights.

AIFR does not guarantee that AI-generated material is copyrightable, exclusive, or free of third-party claims. You must not claim ownership of rights you do not hold.

Streaming platforms and Content ID systems

AIFR is designed in part to provide music that creators and livestreamers can listen to or include while streaming on platforms such as Twitch, YouTube, and similar services.

By submitting music, you acknowledge that AIFR's broadcast may be heard, captured, or included as part of third-party livestreams, videos, clips, VODs, or similar creator content where AIFR permits such use.

You must disclose if submitted music is enrolled in, claimed through, or otherwise controlled by a Content ID, audio-fingerprinting, automated copyright-enforcement, rights-management, or similar system that may automatically claim, mute, block, demonetize, strike, or otherwise interfere with third-party content containing the music.

Examples include YouTube Content ID and comparable automated rights-management systems used by streaming, social-media, distribution, or music-rights services.

AIFR may reject or remove music if:

  • the music is enrolled in a Content ID or similar rights-management system that may interfere with permitted streamer use;
  • automated claims are being made against streamers, listeners, AIFR, or other authorized users because of the track;
  • the submitter cannot or will not release, whitelist, dispute, or otherwise resolve claims affecting uses permitted by AIFR;
  • a distributor, label, publisher, rights-management provider, or other third party controls the track in a manner inconsistent with its use on AIFR; or
  • we reasonably believe continued use of the track could expose AIFR or its listeners, streamers, or other users to copyright claims, strikes, muting, demonetization, account penalties, or similar consequences.

Removal for these reasons may occur even if the submitter owns the music or otherwise had authority to submit it.

Acceptance of a submission does not guarantee permanent availability. If a Content ID or similar conflict is discovered after acceptance, AIFR may temporarily disable or permanently remove the affected track while the issue is investigated or resolved.

Submitters should not enroll music submitted to AIFR in a system that automatically claims permitted streamer use unless they can reliably prevent or release those claims.

License to AIFR

By submitting music and accepting the submission agreement, you grant AIFR a nonexclusive, worldwide license, without payment from AIFR for the rights you are authorized to grant, to:

  • Receive, host, store, copy, and technically process the submitted files, including format conversion and preparation for streaming.
  • Stream, publicly perform, digitally transmit, and make the music available for on-demand listening through the Service.
  • Include it in AutoDJ programming, live programming, playlists, and listener requests.
  • Permit creators to include the submitted music, as carried in AIFR's radio broadcast, in livestreams, videos, clips, VODs, and similar creator content through the permission described in Section 3, to the extent you have authority to grant those rights.
  • Display related artist names, titles, metadata, artwork, and submitted lyrics in connection with the music.
  • Reasonably promote the submitted music and its availability on AIFR using associated metadata, artwork, and reasonable excerpts.

We may use hosting, storage, streaming, and other service providers to carry out these activities on our behalf. The license applies to operating and promoting the Service, including its advertising-supported features. It does not authorize unrelated resale of your music or use of your submission to train an AI model.

AIFR does not promise or pay submitters royalties, submission fees, airplay fees, revenue shares, or other compensation under this agreement. Submission, acceptance, airplay, listener requests, and on-demand availability do not create an entitlement to payment from AIFR. Any different arrangement requires a separate express agreement.

This license applies only to rights you have authority to grant. It does not waive rights belonging to nonconsenting third parties or obligations that applicable law does not allow to be waived.

Review and programming

All submissions are subject to review. We may approve, reject, remove, or stop using material at our discretion, including for programming fit, content standards, rights concerns, or technical quality. Acceptance does not guarantee airplay, continued availability, a particular audience, promotion, or compensation.

Because AIFR is intended to support streamer-friendly listening and restreaming, compatibility with that purpose is part of our submission standards. Music that creates automated copyright claims or similar restrictions for streamers may be rejected or removed even if the music would otherwise satisfy our programming standards.

Uploaded files may be private during processing and review. Accepted music, artwork, and relevant metadata may subsequently become publicly accessible through broadcasting, on-demand playback, and promotion. Your private contact information is not part of the promotional license.

Creator withdrawal requests

If you submitted a track and want it removed, use our contact form and identify the artist, track, and submission. We review the request and may ask for information confirming your identity or authority before removing the track from rotation and applicable on-demand availability.

After verification, we will take reasonable steps to stop future public use within a reasonable period. Withdrawal does not undo completed broadcasts or prior authorized uses, and we cannot retrieve copies independently retained by listeners or third parties. Records and restricted backup copies may remain where needed for technical recovery, administration, disputes, or legal obligations. Retained copies do not authorize continued public playback after withdrawal is implemented.

A creator withdrawal request is separate from a complaint alleging copyright infringement.

5. Copyright complaints

Do not upload or otherwise provide material that infringes another person's copyright. We review copyright complaints and may promptly remove or disable access to disputed material while investigating. We may restrict or terminate accounts or submission access for repeat infringement in appropriate circumstances.

Send copyright complaints to dev@lexian.dev, preferably with "Copyright complaint" in the subject line. Our contact form is also available. Include:

  1. Your physical or electronic signature as the copyright owner or authorized representative.
  2. Identification of the copyrighted work you believe is infringed.
  3. Identification and location of the disputed material, with enough information for us to find it, such as the track title, artist, page URL, or broadcast details.
  4. Your contact information, including your name, address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the disputed use is not authorized by the owner, its agent, or the law.
  6. A statement that the information is accurate and, under penalty of perjury, that you are authorized to act for the owner of the allegedly infringed right.

We may request missing information and notify the submitter about a complaint. If material was removed because of a claimed mistake or misidentification, contact us about the applicable counter-notification process. We will handle valid notices and counter-notifications in accordance with applicable law.

Sending a copyright complaint does not itself create a contractual right to compensation from AIFR. This complaint procedure does not limit statutory rights, defenses, or remedies, and these Terms do not represent that AIFR qualifies for any particular statutory safe harbor.

6. Advertising plans and the free trial

Advertising plans provide the features shown for the selected plan, subject to content approval and these Terms. Features may include advertisement slots, file limits, duration limits, and reporting access. Review the plan description and checkout total before paying.

Seven-day trial

Eligible new accounts receive a seven-day advertising trial starting immediately upon account creation, when a trial plan is available. The trial clock does not wait for email verification, your first login, or your first advertisement upload.

The trial expires automatically and does not automatically charge you or convert into a paid plan. Trial eligibility is limited; do not create multiple accounts or otherwise evade restrictions to obtain repeated trials.

Prepaid periods, extensions, and upgrades

Paid plans are purchased for a selected fixed period, generally between one and twelve months, with the total payable amount shown at checkout. A monthly rate is used to calculate the prepaid price; it is not authorization for recurring monthly charges.

  • New purchases: Paid access starts when payment successfully completes. A purchase during a trial replaces the remaining trial immediately; unused trial time is not added to the paid period.
  • Same-plan extensions: An extension of an active paid plan adds the purchased period to its existing expiry date.
  • Upgrades: An eligible upgrade starts when payment successfully completes and replaces the previous plan. The calculated value of unused paid time is credited against the new purchase as shown at checkout. An upgrade must have a payable balance to be available through checkout.
  • Downgrades: Downgrades are unavailable while a paid plan is active. After expiry, you may purchase an available lower-priced plan.

Paid access runs from its activation date, rather than the date you first upload an advertisement. Contract months follow the calendar-based expiry calculated by the system and shown in your account.

There is no automatic renewal. Paid access expires at the end of the purchased period unless you make another purchase. There is no self-service subscription-cancellation feature because there are no future recurring charges to stop.

Prices for future purchases may change. Such changes do not retroactively increase the price of an already completed purchase or reduce its agreed paid duration. Any material reduction in purchased features will be addressed with an appropriate remedy where required by law.

7. Advertising content, removal, and refunds

You must have the rights and permissions needed for your advertisements, including music, recordings, voices, trademarks, and claims about products or services. Advertisements must comply with applicable advertising laws and the file requirements shown in the Service.

We may reject or remove political, disrespectful, hateful, misleading, unlawful, infringing, or otherwise unsuitable advertising. We reserve editorial discretion to decline advertisements inconsistent with the station's standards, audience, or programming, even if the advertisement is not unlawful. Prior approval does not guarantee continued acceptance.

Unless separately agreed, plans do not guarantee a particular broadcast time, number of plays, listener count, geographic audience, sales result, or other advertising outcome. Analytics are informational measurements and estimates, not a guarantee that an individual heard or acted on an advertisement.

Station-initiated termination

If we remove your advertisement and terminate your paid plan because we find its content unsuitable, we will provide a prorated refund for unused paid time. The refund is based on the paid value attributable to the remaining portion of the active period when termination takes effect, taking account of applicable payments, credits, and prior refunds. Free trial time and other unpaid access have no refundable cash value.

Other refund requests

For other refund requests, including a request to end paid access early or a complaint about service availability, use our contact form. Include the account email and enough payment information to identify the transaction; do not send passwords or full payment-card details.

We review these requests individually. A request alone does not automatically terminate access or establish a right to a refund, except where applicable law requires one. This review process does not limit mandatory refund rights or rights available through the payment provider.

Approved refunds are normally returned through the original payment method where available. Payment-provider processing times may apply. Technical difficulty processing a refund does not remove a refund obligation established by these Terms or applicable law.

8. Voluntary station support

Support payments, sometimes described on the website as donations, are voluntary contributions toward operating and developing AIFR. Listening does not require a contribution.

Contributions do not purchase advertising, guaranteed airtime, music acceptance, services, ownership, or special treatment unless a separate offer expressly says otherwise. We do not offer charitable tax-deduction receipts or represent that contributions qualify as charitable deductions.

Contributions are generally nonrefundable. We may refund duplicate or mistaken payments following review, and we will honor refunds required by applicable law. Contact us promptly with sufficient transaction details if you believe there was an error.

The support form allows you to choose whether your name appears in the public supporter list. An anonymous contribution means withholding your name from that public list; it does not mean your identity is unavailable to AIFR or the payment processor. We do not publish supporter email addresses in that list.

9. Acceptable use and moderation

Use the Service lawfully and respect the rights and safety of others. Do not:

  • Harass, threaten, impersonate, dox, or submit hateful or discriminatory abuse.
  • Provide unlawful, infringing, deceptive, or malicious material.
  • Upload malware, attempt unauthorized access, bypass access controls, or interfere with the Service.
  • Overload streams, automate abusive requests, manipulate listener statistics, or evade rate limits, trial restrictions, moderation decisions, or account restrictions.
  • Use private account or administrative information without authorization.
  • Misrepresent affiliation with AIFR or use its branding to imply an endorsement we have not given.

We may review submissions, restrict features, remove content, or suspend or terminate access for violations, rights concerns, fraud, security risks, or other reasonable operational grounds. We may act immediately where necessary. You may contact us to request review of a decision.

The paid-plan refund commitments in Section 7 and mandatory legal rights continue to apply when access is terminated. Account closure does not automatically remove independently submitted music; use the creator withdrawal procedure if you want that music removed.

10. Privacy, analytics, and communications

We process information needed to operate accounts, review music and advertisements, handle requests and messages, process support payments and advertising purchases, and measure use of the station.

Depending on the feature you use, information may include account names and email addresses; contact and submission details; uploaded audio, artwork, attachments, and metadata; payment and transaction records; and request names and dedications.

Website analytics record visited paths, timestamps, browser information, referrers, and a hashed IP value. A hashed IP value is not a promise of complete anonymity. Hosting and security systems may also process connection information.

The station uses AzuraCast with Full listener analytics enabled. Detailed listener records can include IP addresses, connection times, listening duration, stream choice, user-agent and browser/operating-system details, and approximate location derived from the IP address. IP-derived location is an estimate, not verified physical location.

The configured AzuraCast history-retention period is 14 days, with detailed listener records subject to scheduled cleanup after that period. This period applies to that listener-history system; it is not a statement that all Service data is deleted after 14 days. Aggregate statistics, account and transaction records, submissions, server logs, caches, exports, and backups may have separate retention and handling requirements.

PayPal processes payments under its own terms and privacy practices. Session cookies and similar technical mechanisms support account access and site functions. Other infrastructure and service providers may process information to deliver their services to us.

You may contact us about access, correction, deletion, or other applicable privacy rights. Requests are subject to identity verification and applicable legal requirements. Closing an account may leave records needed for accounting, fraud prevention, disputes, or legal obligations. We do not promise that deletion removes every record from every system immediately.

If you separately subscribe to the newsletter, we may send station-news digests. You can unsubscribe through the newsletter's unsubscribe process. Necessary account, transaction, security, and submission communications are separate from optional newsletters.

Any separately published Privacy Policy provides further details about these practices. These Terms do not replace privacy notices or consent required by applicable law.

11. Third-party services and station content

The Service relies on third-party software, infrastructure, payment processing, and compatible listening applications. Separate third-party services are subject to their own terms. AIFR is not endorsed by AzuraCast, PayPal, an AI music provider, or another third party merely because we use its services or feature related material.

Artist, DJ, advertiser, and guest statements are their own. Featuring content or linking to another site does not necessarily mean AIFR endorses its views, claims, products, or services.

News, weather, automated announcements, and AI-assisted content may contain mistakes or become outdated. They are provided for general information and entertainment. Do not rely on station announcements as your sole source for emergency warnings or other safety-critical decisions; consult appropriate official sources.

12. Station materials and participation

Except for creator-owned content and other third-party material, AIFR's website materials and branding belong to the operator or their respective rightsholders to the extent protected by law. These Terms grant access to the Service, not ownership of its branding, software, or content.

Any participation as a DJ, host, or other station contributor may be subject to a separate arrangement. These Terms do not themselves establish employment, a partnership, an agency relationship, or a right to payment. Any rights or obligations established by applicable employment or other law remain unaffected.

13. Availability, warranties, and responsibility

We aim to provide a functioning station, but technical failures, maintenance, provider outages, rights disputes, and programming changes can interrupt or change the Service. We may change or discontinue free features. Changes affecting paid access remain subject to the purchased commitments, applicable remedies, and these Terms.

To the extent permitted by law, free listening and informational content are provided "as is" and "as available," without warranties of uninterrupted availability, complete accuracy, or fitness for a particular purpose. This does not cancel express paid-service commitments or mandatory warranties and protections.

To the extent permitted by law, AIFR is not liable for indirect or consequential losses, such as lost business opportunities or anticipated advertising revenue, resulting from use of the Service. Nothing excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, intentional misconduct, or other nonexcludable conduct. These limitations do not reduce an express refund obligation.

You remain responsible for your own unlawful conduct and for permissions you represent that you hold. These Terms do not make you responsible for AIFR's independent wrongdoing.

14. Governing law and disputes

Ohio law and applicable United States federal law govern these Terms, without applying conflict-of-law rules that would require another state's law. Mandatory protections available under the law applicable to a consumer remain unaffected.

Please contact dev@lexian.dev first if you have a dispute so we can try to resolve it informally. This is a request, not a condition that prevents timely legal action, emergency relief, or use of a payment-provider dispute process.

Subject to mandatory jurisdiction and venue rules, disputes may be brought in the state or federal courts with competent jurisdiction in Ohio. These Terms do not require arbitration or waive the right to pursue a class action, a jury trial, or another procedure available under applicable law.

15. Changes to these Terms

We may update these Terms as the Service changes. We will publish the updated version with an effective date and provide notice of material changes through an appropriate channel, such as the website or account email. Where renewed acceptance is required, we will request it.

Changes do not retroactively remove accrued rights, alter completed transactions, or expand the authorized uses of previously submitted music without any additional agreement required by law. If you disagree with a change, stop using the affected features and contact us about any existing paid access or submitted music.

16. General provisions and contact

These Terms and any expressly agreed purchase or submission terms govern the relevant Service relationship. A separate written agreement may provide different terms for a specific arrangement. No informal statement about expected airtime or audience size creates a guarantee unless expressly agreed.

If a provision is unenforceable, the remaining provisions continue to apply to the extent legally possible. Failure to enforce a provision on one occasion does not waive future enforcement. Provisions concerning completed payments, prior authorized uses, retained records, lawful liability, and disputes survive termination to the extent necessary to address those matters.
